These Terms and Conditions ("Terms") govern the use of the Ghana Traffic Offence Management System ("the System"), including its associated websites, mobile applications, USSD codes, and related services ("the Services"). By accessing, browsing, or using the System, you ("User", "Offender", "Appellant") agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately cease using the System.

1. Introduction and Scope

The System is a digital initiative of the Government of Ghana (through the relevant transport and security authorities) designed to facilitate the electronic issuance, management, tracking, payment, and adjudication of traffic offences. The System aims to promote transparency, efficiency, and accountability. These Terms apply to all users, including motorists, vehicle owners, law enforcement officers, and third-party payment processors.

2. Fine Issuance and Legal Validity

2.1 Authorized Issuance: Traffic fines are issued solely by authorized law enforcement officers acting within their statutory powers under the Road Traffic Act, 2004 (Act 683) and subsequent amendments.

2.2 Electronic Record: A fine recorded in the System constitutes a valid legal obligation. The User accepts that an electronic facsimile of the offence notice is legally equivalent to a physical copy.

2.3 Presumption of Validity: All fines entered into the System are presumed valid and correctly issued. The burden of proving an error in issuance rests with the User appealing the fine.

3. Payment Obligations

3.1 Due Date: Fines must be paid within fourteen (14) calendar days from the date of issuance, or as otherwise specified on the offence notice.

3.2 Late Payment Interest: If a fine remains unpaid after the due date, a late payment interest rate of 1% per 30-day period (or part thereof) shall accrue on the outstanding principal amount. Interest shall continue to accumulate until the total outstanding balance (principal + accrued interest) is paid in full.

3.3 Payment Confirmation: A payment is not deemed complete until the System receives a successful verification confirmation from the Control Command Centre. Pending bank transactions or reversed charges do not constitute payment.

3.4 Receipts: An official digital receipt, bearing a unique validation code, will be generated only after the Control Command Centre verifies the transaction. It is the User’s responsibility to download and save this receipt. The System is not liable for lost receipts if the User fails to save them.

4. Appeals Process

4.1 Right to Appeal: A User may contest a fine by submitting an appeal within fourteen (14) calendar days of the fine issuance date. Appeals submitted after this period will not be considered unless extraordinary circumstances are proven.

4.2 Effect of Appeal on Interest: Upon submission of a valid appeal, the fine status shall change to "Under Appeal". Interest accumulation on that specific fine shall be paused until a final decision is rendered.

4.3 No Waiver of Fine: Submitting an appeal does not waive the underlying fine. If the appeal is denied, the full fine amount (original principal) plus any interest that accrued prior to the appeal submission remains due immediately.

4.4 Evidence Requirements: All uploaded evidence must be authentic, unaltered, and relevant. Knowingly submitting falsified evidence is an offence under Ghanaian law and will be reported to the Ghana Police Service.

4.5 Finality of Decision: All decisions rendered by the Control Command Centre regarding appeals are final and binding. No further internal appeals will be entertained.

5. User Responsibilities and Prohibited Conduct

5.1 Accuracy of Data: You warrant that all information provided (including vehicle registration, driver’s license number, and contact details) is true, accurate, and complete.

5.2 Prohibited Actions: You shall not:

  • Attempt to hack, disrupt, or overload the System.
  • Use bots, scrapers, or automated tools to access the System.
  • Pay a fine on behalf of another person with the intent to conceal that person’s identity.
  • Create false appeals or submit frivolous challenges.

5.3 Notification of Changes: You are responsible for updating your contact information. The System is not liable for missed notifications due to outdated contact details.

6. Privacy and Data Protection

6.1 Data Collection: The System collects personal data (name, address, contact details, driver’s license) and vehicle data (registration number, VIN) strictly for traffic enforcement and System administration.

6.2 Legal Basis: Processing is conducted under the Data Protection Act, 2012 (Act 843) for the performance of a public duty and compliance with legal obligations.

6.3 Data Sharing: Data may be shared with:

  • The Driver and Vehicle Licensing Authority (DVLA).
  • The Ghana Police Service.
  • Authorized payment gateway providers.
  • Courts and judicial bodies.

6.4 Security: Reasonable technical and organizational measures are employed to protect your data. However, no internet transmission is 100% secure.

6.5 Retention: Data will be retained for a period of seven (7) years following final resolution of a fine, or longer if required by law.

7. System Availability and Limitation of Liability

7.1 "As Is" Basis: The System is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for 99.9% uptime, we do not warrant that the System will be uninterrupted, error-free, or free of viruses.

7.2 Limitation of Liability: To the fullest extent permitted by Ghanaian law, the Government of Ghana, its agencies, and their officers shall not be liable for:

  • Indirect, incidental, or consequential damages (e.g., loss of time, business interruption).
  • Payment failures caused by third-party banks or network providers.
  • Errors resulting from User-provided incorrect information.

7.3 Force Majeure: The System shall not be liable for delays or failures caused by acts of God, war, civil unrest, strikes, or government regulations.

8. Indemnification

You agree to indemnify, defend, and hold harmless the Government of Ghana and its agencies from any claims, damages, losses, liabilities, or expenses (including legal fees) arising out of:

  • Your breach of these Terms.
  • Your misuse of the System.
  • Your violation of any traffic law or third-party right.

9. Amendments to Terms

The System operator reserves the right to update or modify these Terms at any time without individual notice. Changes will be effective immediately upon posting on the System’s official website. Your continued use of the System after any such change constitutes your acceptance of the new Terms. Material changes will be communicated via email (if available) or SMS.

10. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction in Ghana, such provision shall be severed, and the remaining provisions shall continue in full force and effect.

11. Governing Law and Dispute Resolution

11.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana.

11.2 Dispute Resolution: Any dispute arising out of or relating to these Terms or the use of the System (excluding fine appeals, which are governed by Section 4) shall first be submitted to mediation at the Control Command Centre. If mediation fails, the dispute shall be resolved exclusively by the courts of the Republic of Ghana.
